Terms of Use

These Terms and Conditions of Use (the "Terms of Use") apply to Frosthyon and related products operated by LanyGames, Inc. ("LanyGames"), including its subdivision Lumithyon, whether you access them on the web, iOS, Android, or desktop (collectively, the "Services"). BY USING THE SERVICES, YOU AGREE TO THESE TERMS OF USE; IF YOU DO NOT AGREE, DO NOT USE THE SERVICES.

LanyGames reserves the right, at its sole discretion, to change, modify, add or remove portions of these Terms of Use, at any time. It is your responsibility to check these Terms of Use periodically for changes. Your continued use of the Services following the posting of changes will mean that you accept and agree to the changes. As long as you comply with these Terms of Use, LanyGames grants you a personal, non-exclusive, non-transferable, limited privilege to use the Services.

You must be at least 16 years old to use Frosthyon. By using the Services you represent that you meet this requirement and that you have authority to agree to these Terms of Use.

LanyGames, through its Lumithyon subdivision, operates Frosthyon, an AI-powered assistant available on web, mobile, and desktop. Features may include chat, voice, image generation, maps, travel search, social drafting, community (Pulse), account billing, and optional desktop local tools. Features may vary by plan, device, and region. These services may use machine learning, natural language processing, computer vision, and other AI technologies.

You may create an account with email and password or with Google or Apple sign-in. You are responsible for keeping your credentials confidential and for activity on your account. One account is intended to work across web, iOS, Android, and desktop. Instructions to delete your account are at https://lumithyon.com/en/delete-account/.

All text, graphics, user interfaces, visual interfaces, photographs, trademarks, logos, sounds, music, artwork, computer code, and software (collectively, "LanyGames Content"), including but not limited to the design, structure, selection, coordination, expression, "look and feel" and arrangement of such Content, is owned, controlled or licensed by or to LanyGames, Inc., and is protected by intellectual property laws.

Except as expressly provided in these Terms of Use, no part of the Services and no LanyGames Content may be copied, reproduced, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted or distributed in any way for any commercial enterprise, without LanyGames' express prior written consent.

You retain rights in the prompts, files, photos, voice, and other material you submit ("Your Content"). You grant LanyGames a worldwide, non-exclusive license to host, process, transmit, and display Your Content solely to operate and improve the Services (including sending it to AI, speech, image, map, travel, or social providers you use). We do not claim ownership of Your Content for independent commercial sale of your identity.

You represent that you have the rights needed to submit Your Content and that it does not infringe others’ rights or applicable law. AI-generated text and images are provided as-is. You are responsible for how you use generated output, including publication and commercial use.

Certain services, including Frosthyon, utilize artificial intelligence and machine learning technologies. By using these services, you acknowledge and agree that:

(a) AI-generated outputs (including chat, voice, and images) are provided "as is" and may not always be accurate, complete, or current. You should independently verify any information before relying on it for important decisions.

(b) LanyGames may use aggregated, anonymized, or de-identified data derived from your interactions with AI services for the purpose of improving, training, and refining its AI models and systems, in accordance with our Privacy Policy and your training opt-in setting.

(c) You shall not attempt to reverse engineer, extract, or reconstruct the underlying models, algorithms, or training data of any AI system operated by LanyGames.

Voice features require microphone access that you grant on your device. You are responsible for how you use voice in public or around other people. Do not use voice features to capture conversations of others without any consent required by law. Voice output is provided as-is and may be inaccurate.

Paid Frosthyon plans and credit packs are billed by Stripe or PayPal. LanyGames is not the card processor. Plans, message or image quotas, and credits may change; unused credits are not guaranteed to be transferable or refundable except where required by law. Cancel paid subscriptions with Stripe or PayPal (or via in-app manage subscription) to stop renewal. Travel bookings are billed separately by Duffel as described below.

You agree not to use the Services to: (a) upload, post, or transmit any content that is unlawful, harmful, threatening, abusive, defamatory, or otherwise objectionable; (b) impersonate any person or entity or misrepresent your affiliation; (c) interfere with or disrupt the Services or servers; (d) attempt to gain unauthorized access to any portion of the Services; (e) use any automated system including bots, scrapers, or crawlers to access the Services without prior written permission; (f) use the Services to generate content that violates any applicable law or third-party rights.

"LanyGames," "Lumithyon," "Frosthyon," and all associated logos, product and service names, designs, and slogans are trademarks of LanyGames, Inc. You must not use such marks without the prior written permission of LanyGames. All other names, logos, product and service names, designs, and slogans on the Services are the trademarks of their respective owners.

The Services may contain links to or integrations with third-party websites, services, or content that are not owned or controlled by LanyGames (including sign-in, payments, maps, travel, AI hosts, and social networks). LanyGames has no control over, and assumes no responsibility for, their content, privacy policies, or practices. You acknowledge and agree that LanyGames shall not be responsible or liable for any damage or loss caused by the use of any such third-party services.

Map features are provided using Mapbox and related mapping services (which may include Google Places). Map data, routing, and place details may be incomplete or outdated. LanyGames is not liable for reliance on map or location information. Use of maps is also subject to Mapbox terms (https://www.mapbox.com/legal/tos).

Travel search and booking in Frosthyon is facilitated through Duffel. LanyGames is not the merchant of record for travel purchases. Payment is processed by Duffel (or its payment processors, which may include Evervault for card tokenization). Your contract for the ticket, stay, or other travel product is with the airline, hotel, or other supplier, not with LanyGames. Fares, availability, cancellations, refunds, and schedule changes are governed by the supplier and Duffel’s terms. LanyGames does not guarantee prices or that a booking will be confirmed. You should review Duffel’s terms and privacy policy before paying.

If you connect and publish to Instagram, TikTok, LinkedIn, Threads, or similar platforms, you must comply with those platforms’ terms. LanyGames is not responsible for their moderation, outages, or account actions. Publishing is optional.

Community features may allow posts and comments visible to other users. LanyGames may remove content that violates these Terms. You are responsible for what you publish.

Optional desktop integrations (including MCP tools such as Blender) run on your computer with permissions you grant. LanyGames is not responsible for changes those local tools make to your files or applications. Use them at your own risk.

THE SERVICES, THEIR CONTENT, AND ANY ITEMS OBTAINED THROUGH THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. NEITHER LANYGAMES NOR ANY PERSON ASSOCIATED WITH LANYGAMES MAKES ANY WARRANTY OR REPRESENTATION WITH RESPECT TO THE COMPLETENESS, SECURITY, RELIABILITY, QUALITY, ACCURACY, OR AVAILABILITY OF THE SERVICES.

IN NO EVENT WILL LANYGAMES, ITS AFFILIATES, OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, THE SERVICES, ANY WEBSITES LINKED TO THEM, ANY CONTENT ON THE SERVICES, OR ANY SERVICES OBTAINED THROUGH THEM, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

These Terms of Use and any dispute or claim arising out of, or related to them, shall be governed by and construed in accordance with the laws of the United States of America and the State in which LanyGames, Inc. is incorporated, without giving effect to any choice or conflict of law provision.
